Lumen Terms of Service

1. Agreeing to these terms

These Terms of Service ("Terms") govern your use of Lumen at lumenlist.app, a service operated by Patea LLC, a Utah limited liability company ("Patea," "we," "us," or "our"). By creating an account or using Lumen, you agree to these Terms. If you do not agree, do not use Lumen.

2. What Lumen is

Lumen lets families share gift lists. You keep a list of things you would love. The people in your families can see it and mark what they will get for you. You cannot see who is getting what from your own list.

3. Your account

You need an account to use Lumen, and you must be at least 13 years old to have one. A parent or guardian may keep a list for a younger child under the adult's own account.

Give us an email address where you can receive mail, keep your password to yourself, and tell us if you think someone else has used your account. You are responsible for what happens under your account.

4. Families and invitations

Anyone in a family on Lumen can invite others to it, by link or by email. An email invitation is sent in your name, so invite only people you know and who would expect to hear from you.

The person who created a family can rename it, remove members and delete it. When you join a family, its members can see your list.

5. Surprises

Lumen is built so that the owner of a list cannot see who has picked a gift from it. Please keep to the spirit of that. Do not use someone else's account, or any other means, to find out what is being given to you, and do not use what you learn in Lumen to spoil a surprise for someone else.

6. Your content

You keep ownership of what you put into Lumen: your gifts, notes and family names ("your content"). You give Patea a limited license to store, process and display your content only as needed to provide the service, such as showing your list to your families, as described in our Privacy Policy. You confirm that you have the right to post what you post.

7. Store links and gifts

• Lumen can read a product's name, picture and price from a store link you paste. That information comes from the store, may be incomplete or out of date, and is shown as it was saved. Check the store before you buy.
• Links on a list lead to stores and other sites that Patea does not run and is not responsible for.
• Lumen does not sell anything, take orders, handle payments between family members, or deliver gifts. Marking a gift as picked or bought is a note for your family. It is not a purchase, and it is not a promise that Patea stands behind. What is bought, by whom, and whether it arrives is between you and your family.

8. Acceptable use

You agree not to:

• use Lumen for anything unlawful;
• post content that is unlawful, infringing or harassing, or that contains malicious code;
• send invitations as spam;
• try to access another person's account or data;
• interfere with or overload the service;
• scrape, copy or resell the service.

9. Price

Lumen is currently free to use. We may introduce paid plans or paid features in the future. If we do, we will tell you at least 30 days before anything you already use becomes paid, we will not charge you without your agreement, and we will update these Terms with the billing terms first.

10. Ending your use

You can stop using Lumen at any time, and you can ask us to delete your account as described in our Privacy Policy.

We may suspend or close an account that breaks these Terms, or where we need to act to protect the service or other people.

We may change Lumen or stop offering it. If we shut it down, we will give you reasonable notice so you can save what you need.

11. Disclaimers

Lumen is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We work hard to keep gift picks hidden from the person they are for, but we do not warrant that the service will be uninterrupted or error-free, or that a surprise will never be spoiled.

12. Limitation of liability

To the maximum extent permitted by Utah law, Patea's total liability arising out of or relating to Lumen will not exceed the greater of the amount you paid us in the 12 months before the claim or $10. Patea is not liable for indirect, incidental, consequential or special damages, including a spoiled surprise, a duplicated or missing gift, or a purchase made on the strength of information shown in Lumen.

13. Governing law and disputes

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law principles.

Any dispute arising out of or relating to these Terms or Lumen will be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association under its Consumer Arbitration Rules and seated in Utah County, Utah, and not in court. You and Patea each waive the right to a jury trial and the right to take part in a class action. Either of us may bring an individual claim in small claims court instead, where the claim qualifies.

14. Changes to these terms

We may update these Terms from time to time. If a change is material, we will email you before it takes effect. The date at the top of this page shows when the Terms were last changed.
